So one big political news is coming from Tamil Nadu involving AIADMK leader Edappadi K. Palaniswami . Madras High Court just dismissed a petition against him,and honestly,the details are quite interesting.
Basically,a voter from his own Edappadi constituency,Sakthivel Perumal,filed this petition . He claimed that Palaniswami had hidden vital information about his assets and income in election nomination papers. Not a small thing ah.
The whole case started after Palaniswami won his MLA seat in recent Tamil Nadu Assembly elections . The petitioner alleged that there were major inconsistencies between the affidavits Palaniswami submitted for the 2021 and 2026 Assembly elections. He said comparing two documents showed big differences in declared assets.
So this voter wanted Income Tax Department to launch proper investigation into whole thing.
And this is where things get a bit complicated,legally speaking.
During court proceedings,the counsel for Income Tax Department argued that this wasn't right way to go about it . They said similar issues were already sorted out in earlier court orders and that any dispute about election affidavits can only be challenged through election petition under the law,not this kind of writ petition .
Few things standing out clearly in this case:
- The petition highlighted big inconsistencies between documents from different election years .
- The court stressed that such issues must be handled through specific election-related legal processes.
- The court finally ruled that the Income Tax Department was not the right authority to investigate these claims.
So in end,the Division Bench of Madras High Court,which had Chief Justice T.S. Sivagnanam,Justice Aravind Dharmadhikari,and Justice Arul Murugan,agreed with this view . They concluded that what the petitioner was asking for was not legally maintainable and dismissed the case.
This means the attempt to start tax inquiry into Palaniswami's election disclosures is stopped for now . It seems like even if there are questions,you have to follow exact correct legal procedure only .
But it does make you wonder what happens to these kinds of allegations now . Does this mean the questions about the affidavits just disappear,or does someone have to file a different kind of case…
